Terms of Use

1. Introduction

Dear visitor, please read carefully the Terms of Use Agreement available on our website www.globexmaritime.com. Your access to the Platform depends entirely on your acceptance of this agreement and your compliance with the terms and conditions set forth in this agreement. If you do not agree to any of the terms set forth in this Agreement, please terminate your access to the Platform. Please note that if you continue to access the Platform, we will assume that you unconditionally and unrestrictedly accept the entire text of this agreement. www.globexmaritime.com website is managed by Globex Maritime and hereinafter referred to as "PLATFORM". These Terms of Use regarding this platform shall enter into force upon publication. The right to make changes unilaterally belongs to the platform and all our users are deemed to have accepted these changes, which will be shared as up-to-date. Users, through the platform, enter into a distance contract with the Company providing the Services to them under the terms and conditions set out below.

2. Scope

These Terms of Use apply to Users of the Platform who regulate the use of the Platform and govern the distance contracts of the Services. Therefore, the words "you", "your" and generally the use of the second plural form refers to any User and/or Visitor. The use of the first plural form refers to the Company. Visitors must also comply with the Terms of Use when navigating the Platform. As Globex Maritime, we are completely free to determine the scope and nature of the services we will provide within the framework of the law; any changes we make regarding the services will be deemed to have entered into force upon publication on the PLATFORM.

3. Definitions

  1. - Company: The Company "GLOBEX MARITIME ".
  2. - User or Seafarer: A person who creates an account and uses the Platform.
  3. - User / Seafarer Account: Your account after registration on the Platform.
  4. - Visitor: A person who browses the Platform without logging into an account.
  5. - Employer: The shipping company or seafarer agency that registers and uses the Platform.
  6. - Selected Employer: Any Employer who provides access to a User's profile through the Platform.
  7. - Platform: globexmaritime.com website.
  8. - Services: Services provided by the Company to Users.
  9. - Globex Maritime Agreement: The distance contract between the Company and the User for the use of the Services.
  10. - Login Information: The User's credentials that are set for authentication and allow the User to access the Platform.
  11. - Terms of Use or Conditions: These terms of use.
  12. - Parties: Any Seafarer and Employer who choose to exchange information with each other.
  13. - Consumer: Any natural person acting for purposes other than his or her trade, business, craft or profession.

4. Platform Statement

The online platform www.globexmaritime.com appeals to Seafarers and Employers to meet and network with each other and aims to put both Parties in direct contact. At Globex Maritime we focus on Seafarers! Through the Platform, the Seafarer can create a complete professional Seafarer profile in order to stay in contact with the relevant Recruiters who provide access to him/her. The initiative for any kind of communication between the parties lies solely with you. Employers registered on the Platform can access the Seafarers' profiles and learn more about them. Both the choice to make a Seafarer's profile visible to Employers and the choice of an Employer to access the data in a Seafarer's profile do not create any obligations for Seafarers and/or Employers, no contract is automatically concluded between them and no responsibility or liability arises at this stage. Furthermore, the Company shall not be obliged to participate in any way in the Seafarers' employment relationships with the Employers (evaluation / recruitment / employment of the Seafarer, etc.). The parties are free to communicate and contract with each other and the Company's role is limited to providing the Platform and Services to them.

5. User Registration

In order to use the Services, you must register on the Platform. After registration, you may use the Platform Services. Visitors have limited access to the content of the Platform. No Visitor can see Users' personal data. To register for an account, use the available registration form, read and accept the Terms of Use and Privacy Policy and click "Create Account". For more information about deletion of your account and personal data and about your Personal Data, please read the Privacy Policy. Users must fill in the registration form only with true and accurate information. Users are solely responsible for updating their account information and the Company is exempt from liability for any damages that may be caused to the User or a third party due to outdated information provided by the User.

6. Services

The Sailor who wants to create his professional profile must fill in the requested information and create a personal User Account. After registration you can complete your profile by adding information. The visibility of your profile by Recruiters depends on the completion rate you achieve by filling in the requested information. Users must achieve a certain completion rate in order to be visible to Recruiters. Employers can filter the available Seafarers' Accounts on the Platform and see your profile and the personal data you have uploaded. Registered Employers may pay a fee for full access to the Seafarers' Data or provide restricted access free of charge.

7. Terms of Service Provision

The Company is impartial towards Users and offers each of them the same promotional opportunities. The Company may at any time offer the possibility of preferential ranking for the User or better promotion of his/her account to Employers. The Company does not interfere or participate in any way in the pre-contractual / contractual / post-contractual relations of Seafarers and Employers and in the formation of the terms of any contract between them. The Company does not receive any payment or commission fee in exchange for / from the conclusion of an employment contract or any other form of cooperation of the Parties. The Company reserves the right to change the way the Platform operates and to charge for the Services only after prior notice to Users.

8. Globex Maritime Agreement

The terms on which the Globex Maritime Agreement will be concluded are the Terms of Use, supported by applicable law and the Platform's Privacy and Cookie Policies.

9. Internet Access

Use of the platform requires internet access. You must provide internet access with your own care. You are solely responsible for any billing by internet/access services providers required by the use of the internet for the use of the Platform to receive and send data to the Company or to use a Service, etc.

10. Notifications

The Company reserves the right to send you important information regarding the functioning of the Platform, upgrades, improvements and modifications of the Services, modification of the security recommendations of the Services, recommendations for login issues, warnings in case of violation of the Terms of Use or abuse, responses to your requests, changes to the Terms of Use and Privacy Policy, etc. Notification is made on the Platform (pop-up) or by e-mail.

11. Device Requirements

Use of the Platform requires a terminal device (PC, tablet, mobile phone) with the appropriate operating system (e.g. Microsoft Windows, Apple MacOs, Android) and the relevant Internet browser software. You are responsible for the purchase, possession, supply, maintenance and repair of your terminal equipment. The Company is not responsible for the inability of your terminal equipment to access the Platform or the inability/difficulty to view the content of the Platform. If you encounter any problems accessing the Platform, please contact the Company by e-mail at info@globexmaritime.com. The Company does not guarantee the compatibility and smooth operation of the Platform and does not provide any hardware to the User.

12. Access and Use of the Platform

Access to and use of the Platform by the User is subject to these Terms of Use. The Terms of Use apply to the use of the Platform and the Services. The Terms of Use constitute general terms of business which are an integral part of the Globex Maritime Agreement. The Terms of Use apply to the fullest extent permitted by law. You agree to be bound by the Terms of Use when using the Platform. Any User/Visitor, before accessing, browsing and using this Platform in any way (for example: registration, submitting or saving information, etc.), declares that he/she expressly, unconditionally and unconditionally accepts the Terms of Use and, beyond this text, all other terms that may be within the Platform, such as the Privacy Policy and Cookie Policy, which are incorporated into these Terms of Use. What applies to the Terms of Use also applies to all other terms and conditions contained in the Platform. You must unconditionally and unconditionally accept the Terms of Use in order to access and use the Platform. Please read the Terms of Use carefully and comply with them before engaging in any action, interaction, access, transaction or use of the Platform. If you do not agree to the Terms of Use, you must refrain from using the Platform. If you do not intend to work on a ship, you are advised not to register for a Seafarer Account on the Platform. Users are prohibited from having more than one personal account or impersonating another person. The Company reserves the right to delete fake or duplicate accounts. The Platform operates 24/7. The Company reserves the right to change, suspend or discontinue the operation of the Platform and/or Services for you or all Visitors/Users at any time and without prior notice due to maintenance, improvement, update, commercial policy, force majeure, etc. Users must comply with the provisions of the law governing legal capacity to act. For the use of the Services and any valid binding agreement with the Company, the contracting person must have legal capacity to act. Therefore, Users may enter into binding legal agreements with the Company as long as they are adults (age of majority - e.g. at least 18 years old) under applicable law and are allowed to work. All actions taken through the User account after logging in are entirely binding on the User, whether the User has logged in and used the Platform or someone else has used his/her Login Information with or without the User's knowledge/consent/authorization. Therefore, Users are solely responsible for the security of their Login Information and for any damage caused to the Company, themselves or any third party due to unauthorized use of the Login Information. Users must not disclose their Login Information to third parties and must maintain their confidentiality. We advise our Users to notify us immediately if their Login Information is lost, leaked, stolen, intercepted and/or illegally used by an unauthorized person so that we can help them recover/replace such Login Information and protect both them and their personal data. Users activate their accounts by following a link sent to the email they provided when registering, so the owner of a verified email is considered by the Company to be the person using the User's account. Visitors/Users should not attempt to bypass the technical and organizational or security measures taken by the Company to ensure the security of the Platform, should not use bots or software to intercept other Users' personal data held by the Company, and should not store or process personal data for advertising or other purposes. Visitors/Users are obliged not to use the Platform, Services, registration/contact forms or any other means of expression through the Platform or the Company's social media accounts for the purpose of publishing, disclosing, disseminating unlawful, unfair, unwarranted, defamatory, libelous and/or false, threatening, deceptive, coercive, abusive, provocative, insulting, obscene, vulgar, pornographic or racist information, data or any content in general. It is also prohibited to publish content that discriminates, violates any kind of confidentiality, violates constitutional rights, offends professional reputation, privacy and generally violates the law. In addition, Users / Visitors must not publish in any way and in any content advertisements, contests, personal data of third parties, confidential information or trade secrets about the Company or its subsidiaries or other companies, spam messages, chain letters, unlicensed or other malicious software, content protected by Copyright and/or Industrial Property law. It is strictly forbidden for Users/Visitors to interfere with the form, functioning, services, content, databases and other information constituting this Platform by using any mechanism, software, electronic or non-electronic process, whether malicious or not, by sending harmful files such as viruses, spam messages, DDOS attacks, etc. that may affect, damage, suspend, terminate and generally prevent the proper functioning of the Platform or Users from logging in, accessing and using the Platform, which may jeopardize the provision of the Services offered. The Company reserves the right to indemnify the damages incurred due to the abuses mentioned above and to initiate prosecution against those responsible. Visitors/Users may only use the Platform for the purposes for which it was created. Users must not use the Platform for illegal and/or unfair purposes or for the promotion of illegal services or products. Users are liable for any damages caused to the Company or third parties due to any illegal action or use of the Platform. Users must be very careful when entering personal data on the Platform (e.g. when creating an account). They should only enter information that relates to them and should not impersonate anyone else or use other people's information (e.g. contact details). The Company is not liable for any damages resulting from a breach of this condition, nor for any malicious / careless / intentional or unintentional publication of another person's data on the Platform by a User. The Company only provides the Platform Services without any other intervention. Therefore, the Parties acknowledge and agree that they receive the information from any natural or legal person who sends it directly, automatically or upon request. The information posted on the Platform is stored and made available for the convenience of the Parties and each User retrieves the information from the Platform's database at its own risk. Each User has full control over the information submitted and may access, modify, correct, delete, etc. such information at any time. When using the Platform, Users are obliged to accurately provide complete and correct information necessary both for the conclusion of a valid contract with the Company and for the use of the Platform in general. Users/Visitors are obliged to refrain from any action aimed at defaming the Platform or the Company. It is the responsibility of each Seafarer to check and confirm that he/she is qualified and licensed to work as a seafarer. Each Seafarer is solely responsible for confirming that he or she has the right to use the Services exactly as offered by the Platform in accordance with the legislation applicable to him or her. In the event that the law applicable to a Mariner imposes conditions, restrictions and legal obligations on the Company that are inconsistent with the manner in which the Platform operates, such Mariner will refrain from using the Platform or will use the Platform only if it has the right to waive such protective provisions of the law, and continued use of the Platform by a Mariner will constitute a waiver of such protection. If any applicable legislation for the use of the Platform requires you to comply with certain conditions/obligations, you are fully and exclusively responsible for doing so and if you are unable or unwilling to do so, please refrain from using the Platform. Any additional rights that may be granted to the Mariner by any law may only be granted if they are consistent with the way the Platform works as defined by the Company. Otherwise, you must immediately cease use of the Platform and Services.

13. Changes to the Terms of Use

The Company reserves the right to freely and unilaterally change the Terms of Use as provided by law. Users should check whether the Terms of Use have been modified. The publication on the Platform of any new terms or modification or cancellation of an existing term is sufficient to give effect for the future, without prejudice to any rights Users may have by law or the Globex Maritime Agreement. You can check for changes to these Terms by reviewing the date of the last update (Current version). In case you do not agree with any changes to the Terms, you may delete your account and refrain from using the Platform. Continued use of this Platform after the publication of the new/amended terms assumes and confirms that you have read and agree to be bound by the Terms of Use as they stand, together with the aforementioned additions, modifications, interventions and revocations that may have been implemented by the Company.

14. Violation of Terms of Use

All Terms of Use are binding. Violation of these Terms by the User may result in penalties under applicable law and the User's obligation to compensate the Company or any third party for any direct or incidental damages that the Company or any third party may suffer as a result of the User's unlawful behavior and/or violation of the Terms of Use. In case of violation of the Terms of Use, the Company may, without prior notice, prohibit the User from accessing the Platform, delete the User's information published on this Platform, suspend the User's account and exercise all rights provided by law.

15. Limitation of Liability

The Company is constantly improving the security level of the Platform by using programs against viruses and malware. Users are recommended to use software to protect themselves from computer viruses, spyware, malware, ransomware, DDoS Attacks, etc. when using the Services. The Company shall not be liable for any damage to the User's hardware, software and/or data and any other damages that may be caused by the above-mentioned risks to Users or third parties. The Company shall not be responsible for the content of the websites to which Users are directed by links, banners, frames, etc. added to the Platform. The Company shall not be liable for any damages suffered by Users due to visiting such websites, as well as for any damages resulting from risks appearing in the online systems of service providers, organizations advertised on this Platform, affiliates or other collaborating companies, even if Users are directed to such websites by links, banners, frames, etc. on the Platform. The Company does not endorse the content and services of these websites and is not responsible for any damage or loss caused to you by these websites/services. The responsibility and accuracy of the content/information, the security/confidentiality of users and the protection of their personal data and the quality of the services provided are borne solely by the owners, administrators and beneficiaries of the websites in question, and Users visit them at their own risk. In the event that Users violate the Terms of Use, provide incorrect, inaccurate and/or inadequate information or data, engage in misconduct while using the Platform, violate the legal or contractual rules of conduct of the Users, fail to fulfill their obligations under the law or the Globex Maritime Agreement, the Company shall indemnify and hold harmless the Users from any and all damages suffered by the Users, from any and all liabilities, whether contractual or not, to the Users and from any and all direct or incidental claims of the Users. The Company is under no obligation to know whether any information provided by a User is correct and considers the personal data provider to be the actual data subject. Users are obliged to provide only their personal data when using the Platform. The Company is not liable for any damage caused to the User or a third party resulting from the provision of inaccurate/erroneous data by the User, intentionally or unintentionally. Users bear the responsibility for unlawful actions of other data subjects regarding the processing of their personal data. The Company provides the Platform "as is" and "as available" with the features and limitations set by the Company. The Company does not warrant the accuracy, functionality, durability, reliability, compatibility, quality, security and resilience to attack of the Platform and shall not be liable for any permanent or temporary malfunctions. The Company shall in no event be liable to the User or any third party for any direct, indirect or consequential damages or loss of profit/income arising from the use of the Platform or any use of the Services, provided that the Company fulfills its legal obligations. The listings of Employers on the Platform and the information they publish (services, jobs, salaries, vouchers, facilities, etc.) do not imply that we, directly or with our assistance, endorse or approve the content published by each Employer. The Company is not liable for any loss you may suffer as a result of your reliance on any information published by the Recruiters. You should evaluate any information available on the Platform and under no circumstances do we guarantee that such information is not outdated, inaccurate or misleading. The Company has no obligation to examine whether the Employers are operating legally and have the necessary business licenses. The Company does not control, is not obliged to know, does not promise, warrant, guarantee or assume responsibility for the quality, safety, characteristics, availability and other qualities of the Employers' services and/or products. The Company does not guarantee and is not responsible for the Employers' compliance with the relevant legislation. The Company shall not be liable for any obligations of the Parties to the law and to any Government (social security legislation, labor/tax legislation, etc.) arising out of any contract between them. The Company does not verify, know, guarantee or promise the safety of the Employers' premises, the conditions of employment, the hours of work and the remuneration of the work offered. The Company is not responsible for the condition of the Employers' premises, vessels, offices, legality of cargo, etc., compliance with safety and health regulations. The sole responsibility for the foregoing rests with the Employers. Therefore, the Company does not guarantee the safety, health and work of Seafarers and is not liable for any damages arising from any cause whatsoever during the provision of its services to an Employer (loss of income, loss of profits, unpaid wages, accident, injury, poisoning, illness, death, loss of earnings, damage caused by visiting the premises / sites, use of defective equipment or misuse of equipment, non-compliance with health and safety rules, dismissal, work accident, unemployment, war, etc.). The Company does not advise Employers on the selection of Seafarers or the professional development of Seafarers. The Company does not participate in recruitment/employment decisions. The Company has no involvement or participation whatsoever in any communication, understanding, negotiation, compromise, agreement, contract, financial transaction and any other interaction or pre-contractual / contractual / post-contractual relationship and any preparation or other action between the Parties, other than the provision of the Services. The Company does not enter into seafarers' employment contracts or employee lease agreements. The Company has no knowledge of, has no obligation to have knowledge of, does not request information about, and is not a party to, the outcome of any communications and/or negotiations between Employers and Seafarers and is not a party to any employment or other type of contract between the Parties. The Company does not interfere in determining the terms of employment (e.g. working hours, wages, etc.) between the Parties. The Company does not undertake that the use of the Services will lead to your employment and is not liable in any way or to anyone for the consequences of the use of the Platform Services. The Company expressly declares and each Seafarer/Employer agrees that the Company has no obligation: 1) to become involved in out-of-court actions or litigation relating to the relations between the parties, 2) Taking the side of either party, 3) Involve in any dispute of the Parties, 4) Support any claim of the Parties, 5) Intervening in a lawsuit in favor of any of the parties, 6) To answer the requests / questions of the Parties regarding the business relationship between them. The Company shall not be liable for any damages caused to the User or a third party, such as material damage, loss of money or business, loss of profit/income, personal injury, health damage, death, moral damage or mental anguish, emotional distress and any claims that may arise between the Parties. The Company shall not be liable for any damages incurred by the User due to inappropriate Service selection, incorrect request / notification to the Company, etc. While providing the Services, the Company has no general obligation to monitor the information transmitted or stored by Users / Employers on the Platform, nor does it have a general obligation to actively search for facts or circumstances indicating illegal activity. The Company is exempt from any liability for any content posted by Users and/or Employers on the Platform. The Company is not responsible for the loss of any data hosted on its servers. Each User is responsible for keeping a backup copy of the information he/she publishes on the Platform. The Company accepts no liability whatsoever for any loss or damage arising out of your access to and use of the Platform and/or Services and/or any content posted, transmitted or otherwise made available through the Platform. The Company's publication of the Terms of Use and their contents shall not give rise to any greater liability for the Company than that provided by law.

16. Force Majeure

The Company shall not be liable for any delay or failure to fulfill its contractual obligations if such delay or failure is due to force majeure. Force majeure conditions include in particular the following situations: social unrest, revolution, armed conflict, war, nuclear explosion or contamination, famine, earthquake, fire, accident, flood, strike, epidemic, pandemic, extreme weather events and natural disasters, strikes, government restrictions, interruptions or failures of electricity or telecommunications or hosting or internet service provider, cyber attacks, theft, robbery and/or vandalism of the Company's computer systems/networks, terrorist attacks, ransomware, hardware/software failures and problems, etc. Users agree that the Company shall not be liable for any damage or loss suffered by them due to force majeure.

17. Governing Law

The Globex Maritime Agreement is governed by and construed in accordance with the laws of Greece. The quality of the Company's business and the content of the Platform and any dispute arising out of the Globex Maritime Agreement or the law shall be governed by applicable law.

18. Copyright

The Company reserves all intellectual/industrial property rights to all content of the Platform, including texts, images, videos, drawings, photographs, photographs, graphics, designs, logos and trademarks, computer animation, software, databases, music and audiovisual excerpts, advertising images and slogans, source code, etc. All content of the Platform as well as its distinctive features are protected under the provisions of unfair competition and industrial property law. In particular with respect to the Platform's databases, any reproduction of these databases by any means and in any form, in whole or in part, temporarily or permanently, translation, adjustment, editing or any other modification of these databases, any distribution of the databases or copies thereof to the public, any public disclosure, display, purchase or offering of these databases, uploading, storing and exporting, downloading, posting on another website, posting on the internet and any other processing and commercial use of the databases are prohibited without the Company's permission. The automatic (e.g. through web scraping, web harvesting, web data extraction) or manual collection and storage of information contained in the Platform's databases or the bulk/systematic downloading of information for any use by the Platform is also prohibited, without prejudice to any rights granted to you by the Company. The domain name www.globexmaritime.com is duly registered by the Company, which has the exclusive right of use and prohibits any third party from registering the same or a similar domain name. You may use the Platform as authorized by the Company and only under the options and restrictions set by the Company (AS IT IS). Therefore, you are not entitled to reverse analyze or reverse compile the Platform, bypass its limitations in any way and interfere with its source code. You also do not have the right to copy, publish, distribute, rent, lease, exploit, lend, sell, transfer, or take any other action in excess of the license to use granted to you. By accepting these Terms of Use, the Company grants you a license to use the Platform. With this license transfer, you obtain a personal, limited and non-exclusive right to use the Platform. You may not assign, lease, transfer or grant this right to a third party. You do not acquire the right to use the Platform or its content, but only in accordance with applicable legislation. The Employers whose trademarks and other intangible assets are displayed on the Platform are the exclusive owners and beneficiaries of the intellectual and industrial property rights over all such assets, and the display of such assets on the Platform is permitted only after the registration of each Employer on the Platform and no User has the right to challenge the rights of the Employers over them. Infringement of the Company's or a third party's Intellectual Property gives rise to the obligation of the responsible User to indemnify the Company or a third party for any damage caused. In case of infringement of Intellectual Property rights, the Company may ban the User from the Platform, delete his/her account and exercise all the rights provided by law. All CVs uploaded to the Platform and their contents are the intellectual property of the Seafarers. Seafarers grant the Company a perpetual, worldwide, royalty-free and irrevocable right to store, classify, display, create links to and make available these CVs on the Platform and in particular to the Employers selected by them.

19. Feedback

We aim to continuously improve the Platform. We encourage users to send us their complaints, suggestions and comments regarding the operation of the Platform. You grant the Company the right to use any comments, reviews, evaluations, ratings, requests, requests, requests, suggestions, recommendations, advice, complaints, ideas, opinions, reports that you send to us or post on the Internet in any way. The Company has the right to publish the above materials without any compensation to you for the purpose of promoting the reliability/quality of the Platform.

The headings in these Terms of Use are used for convenience only and do not limit or otherwise affect the literal meaning of such terms.

23. Current Version

The Company updates the Terms of Use to adapt to changes in the operation of the Platform, the Services or the law. The last update of the Terms of Use was made on 10/06/2024.
